Family in the woods: the Court of Appeal in L'Aquila dismisses the parents' appeal

L'Aquila, 30 April (LaPresse) – The Court of Appeal in L'Aquila has dismissed the appeal lodged by the lawyers representing the “family in the woods” from Palmoli (Chieti), Marco Femminienella and Danila Solinas. The judges confirmed that the three minor children – 6-year-old twins and an 8-year-old girl – are to remain in a secure foster home in Vasto (Chieti), where they have been since 20 November last year. The judges justified their decision by emphasising the need to ensure the children receive an adequate standard of education and proper socialisation, elements deemed lacking in the isolated environment in which the family lived. Although some progress was acknowledged in the path undertaken by the parents, the court rejected the appeal against the order of the Juvenile Court, confirming the children’s placement within the care facility. Currently, the mother is permitted to visit the children during the day, but the children remain in the care of the external facility. The case has sparked widespread public debate regarding the choice of Nathan Trevallion and Catherine Birmingham to live in isolation and pursue a zero-impact lifestyle. The couple’s lawyers have already lodged new appeals to request the children’s return, arguing for the family’s right to remain united, whilst respecting different lifestyle choices. The judiciary, however, has reiterated the priority of the children’s right to education and to grow up in a suitable social environment. The court-appointed expert confirmed a few days ago that both parents are unfit to care for their children.
