Milan, 26 March (LaPresse) – The European Commission has provisionally found that Pornhub, Stripchat, XNXX and XVideos have breached the Digital Services Act (DSA) by failing to protect children from exposure to pornographic content on their services. The Commission’s preliminary findings indicate that Pornhub, Stripchat, XNXX and XVideos failed to identify and assess, with due diligence, the risks their platforms pose to minors accessing their services. Even where risks were identified, Pornhub, Stripchat, XNXX and XVideos did not conduct a thorough assessment, as they failed to use objective and comprehensive methodologies. For example, the assessment placed undue emphasis on commercial concerns, such as reputational damage, rather than focusing on social risks to minors, as required by the DSA (Digital Services Act). Furthermore, the findings show that in their risk assessments, Stripchat, XVideos and XNXX misrepresented or failed to take into account meetings held with civil society organisations specialising in children’s rights and age verification tools.
