Milan, 13 January (LaPresse) – The hearing at the Genoa Review Court for the release of those involved in the investigation into the alleged financing of Hamas is scheduled for next Friday at 9 a.m. In a statement, Nicola Canestrini, Fausto Gianelli, Elisa Marino, Gilberto Pagani, Pier Poli, Marina Prosperi, Nabil Ryah, Dario Rossi, Flavio Rossi Albertini, Giuseppe Sambataro, Fabio Sommovigo, Emanuele Tambuscio, Gianluca Vitale and Samuele Zucchini, defence lawyers for those involved, ‘feel it is their duty to speak out publicly to denounce a serious distortion of the principles of the rule of law, international criminal cooperation and the fundamental guarantees of criminal proceedings, starting with the presumption of innocence, which has once again been openly violated’. The investigation, the note points out, ‘does not concern criminally proven conduct, but the transmission and circulation of information acquired in a war scenario, originating from an ongoing armed conflict and produced by foreign security apparatus’. "This is not judicial evidence, but intelligence material. It is information that has not been validated, has not been subject to judicial review, and lacks the minimum guarantees of reliability required in a state governed by the rule of law."
