Rome, Feb. 4 (LaPresse) – “In the crime of stalking and assault, the motive of jealousy does not mitigate the offense. On the contrary, it could aggravate it.” This was established by the Fifth Criminal Section of the Supreme Court of Cassation, ruling on an appeal (which was rejected) by the defense of a man sentenced to 9 months and ten days of imprisonment, later replaced by a fine of 5,000 euros, by the court of Busto Arsizio in Lombardy. According to the Supreme Court judges, presided over by Rosa Pezzullo, jealousy is a “morbid” feeling, expressing “supremacy and possession,” which constitutes an aggravating circumstance as it involves “acting for trivial or vile reasons.”
